ADMINISTRATIVE HEARINGS AND APPEALS

Cacace, Tusch & Santagata represents clients before municipal and state regulatory agencies. Our attorneys have addressed issues involving planning and zoning, building and health code compliance, state and municipal taxation, workers compensation, unemployment compensation, employment discrimination, liquor permits, state licensure, and fair rent compliance. Our experience includes providing representation at every level of the administrative process, from administrative boards and agencies, to appellate work in the Connecticut Superior, Appellate and Supreme Courts.

BUSINESS AND CORPORATE LAW

The firm's business and corporate practice involves the representation of clients in a variety of corporate and commercial transactions. Cacace, Tusch & Santagata has represented clients in the establishment of various corporations, partnerships, limited partnerships, and limited liability companies. The firm has also negotiated buy-sell agreements and various stock purchase agreements for its clients, and has assisted individual clients and financial institutions in obtaining corporate financing.

CIVIL LITIGATION

Cacace, Tusch & Santagata represents clients in civil trials and appeals in the state courts and federal courts throughout Connecticut. The type of litigation matters handled by the firm include construction litigation and arbitration, bond disputes, foreclosure and collection actions, employment disputes, real estate tax appeals, personal injury actions, consumer complaints such as lemon law claims, and various contract and commercial disputes.

CRIMINAL LAW

As a component of its full service practice Cacace, Tusch & Santagata has represented clients in defense of a variety of criminal charges. This work has included the representation of clients in connection with motor vehicle violations, suspension hearings before the Motor Vehicle Commissioner, and the resolution of misdemeanors and felonies.

ELDER LAW

Elder law is a relatively new area of specialization which encompasses a number of other areas of law. The principal "core" areas are health and personal care planning involving medical directives and counseling older persons and their families on medical choices; public benefits advice including planning for and assisting in obtaining medicare and medicaid; counseling on the level of capacity required for various legal activities; and the estates and probate practice as mentioned below. Two of the attorneys in the firm are members of the National Academy of Elder Law Attorneys.

ESTATE PLANNING AND PROBATE

Cacace, Tusch & Santagata has an active estates practice in which members of the firm advise clients as to the disposition of their property upon their death. Included in this practice is the drafting of wills, trusts, powers of attorney, and living wills. Cacace, Tusch & Santagata also assists clients in the probating of estates. In addition, the firm provides representation to clients in various other probate proceedings including guardianships, conservatorships, adoptions, and name changes.

FAMILY LAW

Cacace, Tusch & Santagata represents clients in legal separations, divorces, custody disputes and paternity disputes pending in the family courts in Stamford, Bridgeport, New Haven and Danbury. In addition, members of the firm have been appointed by the Connecticut Superior Court to act as special counsel to minor children and as guardians ad litem to minor children in cases in which custody is in dispute. The firm also assists in the preparation of prenuptial agreements.

LANDLORD/TENANT

From the beginning of a landlord/tenant relationship to its termination, Cacace, Tusch & Santagata has represented clients in all aspects of rental transactions. The firm's representation has included the drafting, negotiation and execution of leases and other rental agreements on behalf of commercial and residential landlords and tenants. Cacace, Tusch & Santagata has also represented commercial and residential landlords and tenants in eviction proceedings and proceedings to enforce lease agreements.

Members of the firm have extensive experience representing buyers and sellers in separate transactions. The firm has also represented numerous clients in obtaining financing from banks and other lending institutions. In addition, the firm represents several local banks in various financing transactions. The firm has experienced full-time certified paralegals on staff to assist our attorneys and our clients in their real estate transactions.

TELECOMMUNICATIONS LAW

Cacace, Tusch & Santagata represents a broad spectrum of clients in the business of providing telecommunications services both within Connecticut and across the nation. Telecommunications law is an area of specialization which has seen enormous growth as a result of changes in the statutory and regulatory structure governing the telecommunications industry in recent years. Our attorneys follow this rapidly developing area closely so as to meet this leading industry's trends and demands. Our telecommunications practice includes the representation of commercial telecommunications providers in the acquisition of sites and in obtaining any required municipal and state approvals for the construction and operation of their facilities. We also represent carriers in both federal and state courts in cases arising out of violations of the Telecommunications Act of 1996.

VALUATION OF PROPERTY

Cacace, Tusch & Santagata has represented numerous clients in matters involving property valuation. This work includes foreclosures, condemnation, lease contests and tax valuation. One of our recent tax appeals has resulted in a Supreme Court decision which found for the first time that an average ratio of sales to assessments was properly utilized, and established a means for trending back a value for new construction that comes on between decennial valuations.

ZONING AND LAND USE PLANNING

Cacace, Tusch & Santagata is perhaps best recognized for its extensive work before local and state land use boards, planning boards, and various other administrative departments on behalf of local owners. Our land use practice ranges from the representation of the homeowner to the representation of large commercial developers. In addition to representation before administrative agencies, members of the firm have represented clients in land use cases in the Connecticut Superior Court, Appellate Court, and Supreme Court.
